GENERAL TERMS AND CONDITIONS
Article 1: Applicability
1.1. These general terms and conditions apply if Karel Sterckx (hereinafter referred to as Wilderness Retreats Inari) with company number BE 0671.572.768, provides services to a client including – but not limited to – training courses, courses or training, both with open registration and “in company”.
1.2. The client declares to have taken note of these general terms and conditions in a language that he understands and to accept them in full without any reservation. The client thereby completely waives the application of his own general terms and conditions.
Article 2: Registration for services
Registration takes place by sending a registration form by post, e-mail or via the website.
By registering, the client agrees to these general terms and conditions.
Article 3: Confirmation
Wilderness Retreats Inari will confirm the registration in writing by post or e-mail.
Only the agreement for the performance of services accepted in writing by Wilderness Retreats Inari binds Wilderness Retreats Inari according to the special conditions agreed in writing and according to the present general conditions.
Article 4: Price and Payment
4.1. The price for the performance of services is as stated in the agreement or on the invoice.
4.2. After registration, the client will receive an invoice by e-mail. This invoice must be paid within 14 calendar days, unless a different payment term is stated on the invoice.
In the event of non-payment or late payment, the client, without notice of default, owes default interest of 12% on the outstanding amounts and compensation of 10% for administration costs from the due date of the invoice.
If the client does not pay within the agreed term, legal proceedings will be initiated to politely but firmly point out the client's obligations. All costs incurred for collection will be borne by the client.
4.3. The client is responsible for payment of the participation fee. Wilderness Retreats Inari cannot be held to deviating agreements in this regard.
4.4. Disputes regarding the invoice must be reported to Wilderness Retreats Inari by the client by registered letter within 10 days of the invoice date, under penalty of forfeiture.
4.4. Debt settlement by the client is expressly excluded.
Article 5: Cancellation by client
Any cancellation by the client shall be made in writing via e-mail to the attention of Wilderness Retreats Inari. Cancellations made by phone call or voicemail message will not be considered received unless supplemented by written cancellation.
Cancellation fees (as Percentage of Estimated Event Value) are in accordance with the sliding scale outlined below:

31-60 days: 50%
61-90 days: 35%
91 or more days: 25%
Article 6: Cancellation, modification or rescheduling by Wilderness Retreats Inari
6.1. In case of insufficient registrations, Wilderness Retreats Inari reserves the right to cancel or postpone an event.
6.2. Wilderness Retreats Inari also reserves the right to change a program as a result of unexpected circumstances.
6.3. Wilderness Retreats Inari is released by operation of law and is not obliged to fulfill any obligation towards the client in the event of force majeure. Force majeure is understood to mean the situation in which the execution of the agreement by Wilderness Retreats Inari is prevented in whole or in part, temporarily or otherwise, by circumstances beyond the control of the latter, even if this circumstance was already foreseeable at the time the agreement was concluded. Without being exhaustive, the following are considered to be cases of force majeure: natural events (these may include earthquakes, floods, fire, plague, and other natural disasters), political and special events (these may include terrorism, riots or civil disturbances; war, whether declared or not; strikes, change of law or regulation, nuclear or chemical contamination, pressure waves from devices travelling at supersonic speeds, failure of public infrastructure).
In such cases, Wilderness Retreats Inari will inform the client as soon as possible.
6.4. In the event of cancellation, the participation fee already paid will be refunded to the client. If a training course does not take place at a certain time due to insufficient registrations and the training course is offered at multiple times, Wilderness Retreats Inari will offer the client the opportunity to participate in the course at another time for a discount of 10% on the participation fee. If the client does not accept this offer, the participation fee already paid will be refunded.
Article 7: Liability
7.1. Wilderness Retreats Inari will make every effort to optimally perform all activities, both in terms of content and organisation and related to the training course.
The client acknowledges and accepts that Wilderness Retreats Inari’s obligations are purely obligations of means.
7.2. The client is obliged to check for himself whether he is medically fit to follow a certain course, training or education.
The client always consults his doctor first and obtains a medical certificate for practicing the training program chosen by him/her.
Wilderness Retreats Inari accepts no responsibility or liability for any damage, injuries or losses that may result from practicing the training program chosen by the client. The client will sign the waiver.
Wilderness Retreats Inari is not liable for damage related to participation in the training or caused by cancellation by Wilderness Retreats Inari, by its employees or by other persons employed by or on behalf of Wilderness Retreats Inari or whose services have been used by Wilderness Retreats Inari.
7.3. Wilderness Retreats Inari is therefore only liable for damage that is the direct result of a concretely proven error and is not liable for indirect damage of any kind, nor for damage as a result of liability towards third parties.
7.4. Wilderness Retreats Inari’s liability is in any case limited to the value of what has been performed, which will be determined on the basis of the invoice from Wilderness Retreats Inari issued in the name of the client.
Art. 8 Copyright
The course material provided becomes the property of the client. The copyright on the course material and the other materials provided with the course rests with Wilderness Retreats Inari or with the person who provided or wrote the material.
No data from or parts or extracts of the provided training material may be reproduced or published in any way whatsoever without the express written permission of Wilderness Retreats Inari.
Art. 9: Replacement of teacher(s)
Wilderness Retreats Inari reserves the right to replace teachers charged by it with the execution of the training with other teachers.
Art. 10: Complaints
Complaints about the services provided to the client must be communicated in writing and with reasons within 8 days after the training was provided, failing which the client is deemed to have agreed to the delivery and to have waived all rights and powers that the client has under the law and/or agreement.
Art. 11: In-company training
Agreements about “in-company” training are recorded in a separate contract. If the client or Wilderness Retreats Inari cannot comply with these agreements due to unforeseen circumstances, both parties will enter into consultation as soon as possible about postponement or cancellation. Costs resulting from this will be borne by the party that cannot comply with the agreement.
Article 12: Notifications
The client expressly acknowledges that all notifications by Wilderness Retreats Inari can be validly made when sent by e-mail.
Article 13: Dispute resolution
13.1. All disputes between the parties fall under the exclusive jurisdiction of the courts of Leuven, without prejudice to the authority of Wilderness Retreats Inari to seize the Common Law Court that has the territorial jurisdiction.
13.2. All agreements between the parties are exclusively governed by Belgian law.
